Cowboys RB Ezekiel Elliott’s Suspension Reinstated

Judge Katherine Polk Failla dissolved the temporary restraining order and denied the NFLPA and Cowboys RB Ezekiel Elliott‘s motion, which means his six-game suspension has been reinstated by the judge, according to Amy Dash.

Judge Failla writes:

After reviewing the parties’ comprehensive written submissions and hearing extensive oral argument earlier today, the Court concludes that, on this record, the NFLPA has failed to demonstrate a substantial question warranting the extraordinary remedy of injunctive relief or a balance of hardships that decidedly weighs in its favor. While reasonable minds could differ on the evidentiary decisions made by the arbitrator, the proceedings in their totality accorded with the CBA and the PCP — and, to the extent such an inquiry applies, with precepts of fundamental fairness. The arbitrator gave Mr. Elliott ample opportunity, in terms of both proceedings and evidence, to challenge the Commissioner’s decision before the arbitrator; the arbitrator’s ultimate decision against Mr. Elliott does not render these proceedings any less fair. Accordingly, the Court dissolves the temporary restraining order that has been in place since October 17, 2017, and denies the NFLPA’s motion.”

The NFLPA will now have 24 hours to appeal the ruling, according to Dash.

This, of course, means that Elliott is in line to miss the next six games of the regular season against the Chiefs, Falcons, Eagles, Chargers, Redskins and Giants.

Elliott was accused of five incidents of domestic violence that took place over over the course of a six-day period in July 2016, which led to the NFL suspended him six games.

Elliott, 22, was taken with the No. 4 overall pick by the Cowboys back in May. He signed four-year contract worth $24,956,342, which includes a signing bonus of $16,350,068.

Elliott stands to make base salaries of $1.58 million (2017), $2.71 million (2018), and $3.85 million (2019) over the remainder of the contract. The agreement also includes a fifth-year option for the team to pick up in 2019.

In 2017, Elliott has appeared in seven games and rushed for 690 yards on 164 carries (4.2 YPC) to go along with 19 receptions for 210 yards receiving and eight total touchdowns.
