Ray McDonald Indicted On Rape Charge & 49ers Ahmad Brooks Charged With Sexual Battery

49ers GM Trent Baalke released a statement regarding the news that OLB Ahmad Brooks is facing a sexual battery charge.

The organization is aware that a misdemeanor charge has been filed against Ahmad Brooks stemming from a December 2014 matter. We take any charge against a member of this organization seriously and are in communication with the NFL. Ahmad is returning home to California and will not participate in Saturday’s game.”

According to Tracey Kaplan of the San Jose Mercury News, former 49ers DE Ray McDonald has been indicted on one count of raping an intoxicated woman after a party that took place at his residence back in December of last year.

McDonald was also indicted by the grand jury for violating a May 27 domestic violence restraining order. This is a misdemeanor charge that carries a maximum of one year in jail.

Current 49ers OLB Ahmad Brooks has also been charged on one count of misdemeanor sexual battery against the same woman at the same party.

McDonald sued the alleged victim for defamation of character following his release from the 49ers, but that lawsuit was dismissed in June.

Kaplan mentions that McDonald was set to be arrested Wednesday afternoon and faces a maximum of eight years in prison if he ends up being convicted of the rape.

As for Brooks, he faces up to six months in jail for his sexual battery charge.

Sources have told Kaplan that the alleged assaults were caught on videotape by McDonald‘s security system.

McDonald, 30, was also involved in a domestic violence incident, which led to the Bears releasing him back in May.

In 2014, McDonald appeared in 14 games and recorded 39 tackles, three sacks, and a forced fumble for the 49ers. Pro Football Focus has him rated as the N0. 12 defensive end in a 3-4 defense out of 47 qualifying players.

It’s very likely that his NFL career is over.

Brooks, 31, has three years remaining on his six-year, $37 million contract that included $8.25 million guaranteed.

In 2014, Brooks appeared in 13 games for the 49ers and recorded 30 tackles, six sacks, a forced fumble, a recovery,  and three pass defenses.
