Update:
49ers GM John Lynch released a statement following the news that the domestic violence charges against LB Reuben Foster have been dropped saying that Foster can rejoin the team on Thursday:
โThe organization is aware the domestic violence charges against Reuben Foster were dismissed earlier today. As a result, he will have the opportunity to rejoin the team tomorrow. It has been made clear to Reuben that his place on this team is one that must continue to be earned. We will continue to monitor the remaining misdemeanor charge.โ

On Wednesday, a Judge Nona L. Klippen ruled that there is insufficient evidence to proceed with domestic violence charges against 49ers LBย Reuben Foster, per Matt Maiocco.
Fosterโs charge of possession of assault weapon was reduced to a misdemeanorย and a pre-trial has been scheduledย for June 6.
The Judge cited how Foster’s ex-girlfriendย was โunusually calmโ in 911 calls, had no photo evidence of injuries from being punched, and the fact that she previously went to jail for false domesticย violence claims against another ex-boyfriend.
Last week,ย Fosterโs ex-girlfriend,ย Elissa Ennis, testified that she lied to police on Feb. 11 following incident because she “wanted to be extra, wanted him to go down and was pissed” after he broke up with her that morning.
โI was threatening Reuben. … that I was going to f*** up his career,โ Ennis said, per Cam Inman.
Ennis added that she called 911 three times because: โI wanted to be extra. I wanted him to go down. I was pissed.โ
When asked by the prosecution if Foster put his hands on her, Ennis answered: โNo, sir. Not once.โ
According to Ennis,ย โIt was all a money scheme. I didnโt want to get this far in the news. It was about money.โ
โI was lying about a bunch of stuff,โ she said, per Matt Maiocco.
Ennis explained thatย she got in a fight with two women in San Francisco before comingย home to Fosterโs Los Gatos home and going to bed, per Evan Sernoffsky.ย In the morning, Foster broke up with her.
Ennis reportedly testified at Foster’s preliminary hearing against the advice of her attorney Stephanie Rickard, who advised her to take advantage of her fifth amendment right not to incriminate herself.
Foster, 24, is a former first-round pick of the 49ers back in 2017. He’s entering the second year of his four-year, $9.03 million contract and stands to make base salaries of $875,708 and $1.28 million over the next two years of the agreement.
The 49ers will have a fifth-year option to pick up in 2020 that’s guaranteed for injury only.
In 2017, Foster appeared in 10 games and recorded 72 tackles, no sacks or interceptions and one pass defense.ย Pro Football Focus has him rated as the No. 4 linebacker out of 88 qualifying players.
